Alabama

Waiting Period: A patient seeking abortion must contact/visit their abortion provider to receive counseling and then wait 48 hours before having an abortion

Parental Notification: Any minor that is not legally emancipated is required to obtain parental consent from one parent. A minor that is not capable of doing so can file to go through the judicial bypass process.

 

Alaska

Counseling Requirement: Alaska abortion providers are required to distribute documents compiled by the state and/or must conduct state regulated counseling. These documents regard fetal pain and breast cancer risk.

Arizona

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in-person counseling and then wait 24 hours before having an abortion.

Parental Notification: Any minor that is not legally emancipated is required to obtain parental consent from one parent. A minor that is not capable of doing so can file to go through the judicial bypass process.

 

Arkansas

Counseling Requirement: Arkansas abortion providers are required to distribute documents compiled by the state and/or must conduct state regulated counseling. These documents regard fetal pain and is only given to patients who are at least 20 weeks gestation.

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in-person counseling and then wait 72 hours before having an abortion.

Parental Notification: Any minor that is not legally emancipated is required to obtain parental consent from at least one parent. A minor that is not capable of doing so can file to go through the judicial bypass process.

 

California

No legislative restrictions

 

Colorado

Parental Notification: Any minor who is not legally emancipated must notify both parents at least 48 hours before obtaining an abortion. In certain circumstances, the minor is only required to notify one parent. A minor that is not capable of doing so can file to go through the judicial bypass process.

 

Connecticut

No legislative restrictions. 
 

Delaware

Parental Notification: Any minor under the age of 16 who are not legally emancipated are required to notify at least one parent 24 hours before having an abortion. A minor not capable of doing so can file to go through the judicial bypass process.

 

Florida

Parental Notification: Any minor in Florida that is not legally emancipated must notify two parents 48 hours prior to having an abortion. Any minor not capable of doing so can file to go through the judicial bypass process.

 

Georgia

Counseling Requirement: A patient seeking abortion must contact/visit their abortion provider to receive counseling and then wait 24 hours before having an abortion. These documents regard fetal pain.

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in-person counseling and then wait 24 hours before having an abortion.

Idaho

Counseling Requirement: Indiana abortion providers are required to distribute documents compiled by the state and/or must conduct state regulated counseling. These documents regard fetal pain.

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in-person counseling and then wait 18 hours before having an abortion.

Parental Notification: Any minor that has not been legally emancipated must obtain consent from on parents 48 hours prior to having an abortion.

Iowa

Parental Notification: Any minor in Iowa who is not legally emancipated or have never been married must notify one parent at least 48 hours prior to having an abortion. A minor who is not capable of doing so can file to go through the judicial bypass process.

 

Kansas

Counseling Requirement: Kansas abortion providers are required to distribute documents compiled by the state and/or must conduct state regulated counseling. These documents regard fetal pain, negative psychological effects, and breast cancer risk.

Waiting Period: A patient seeking abortion must contact/visit their abortion provider to receive counseling and then wait 24 hours before having an abortion.

Massachusetts

Parental Notification: Any minor who has not been married or legally emancipated must obtain consent from one parent prior to having an abortion. A minor not capable of doing so can file to go through the judicial bypass process.

 

Michigan

Waiting Period: A patient seeking an abortion must visit their abortion provider to meet with a qualified professional to fill out consent forms and receive in-person counseling 72 hours prior to an abortion. The patient then must wait those 72 hours before having an abortion.

Parental Notification: Any minor who is not legally emancipated must obtain consent from one parent prior to having an abortion. A minor not capable of doing so can file to go through the judicial bypass process.

 

Montana

No legislative restrictions. 
 

Nebraska

Counseling Requirement: Nebraska abortion providers are required to distribute documents compiled by the state and/or conduct state regulated counseling. These documents regard negative psychological effects.

Waiting Period: A patient seeking abortion must contact/visit their abortion provider and receive counseling then wait 72 hours before having an abortion.

Parental Notification: Any minor who is not legally emancipated must notify a parent at least 48 hours before having an abortion and receive consent from one parent before having an abortion. A minor who is not capable of doing so can file to go through the judicial bypass process.

 

Oregon

No legislative restrictions. 

 

Pennsylvania

Parental Notification: Any minor under the age of 17 who is not legally emancipated must obtain consent from one parent or grandparent prior to having an abortion. A minor who is not capable of doing so can file to go through the judicial bypass system.

 

South Dakota

Counseling Requirement: South Dakota abortion providers are required to distribute documents compiled by the state and/ or conduct state regulated counseling. These documents regard fetal pain and negative psychological effects.

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in-person counseling more than 72 hours before their abortion. The patient then must wait 72 hours, but hours will not be counted if they fall on an annual holiday or the weekend.

Parental Notification: Any minor who is not legally emancipated must notify one parent 48 hours prior to having an abortion. A minor not capable of doing so can file to go through the judicial bypass process.

 

Tennessee

Counseling Requirement: A patient seeking an abortion must visit their abortion provider to receive in person counseling and then wait 48 hours before having an abortion.

Texas

Counseling Requirement: Texas abortion providers are required to distribute documents compiled by the state and/or conduct state regulated counseling. These documents regard breast cancer risk, fetal pain, and negative psychological effects.

Waiting Period: A patient seeking abortion must contact/visit their abortion provider to receive counseling and then wait 24 hours before having an abortion.

Parental Notification: Any minor who is not legally emancipated must notify and receive consent from one parent prior to having an abortion. A minor who is not capable of doing so can file to go through the judicial bypass process.

Utah

Counseling Requirement: Utah abortion providers are required to distribute documents compiled by the state and/or conduct state regulated counseling. These documents regard fetal pain and is only given to patients who are at least 20 weeks gestation.

Waiting Period: A patient seeking abortion must visit their abortion provider to receive in person counseling and then wait 72 hours before having an abortion. The waiting period can be waived in cases of rape, incest, fetal defect or if the patient is younger than 15.

Parental Notification: Any minor who is not legally emancipated must notify one parent and receive consent from one parent 24 hours prior to having an abortion. A minor not capable of doing so can file to go through the judicial bypass process.

Vermont

No legislative restrictions. 

 

Virginia
